This sample has (1) a Motion on Notice, (2) An Affidavit in Support of the Motion and (3) a Written Address in support of the preliminary objection. A preliminary objection allows the defendant to remind the Court that there is a challenge to the court’s jurisdiction and that the Court should not continue with the case before it.  A preliminary objection to a counterclaim alerts the court to reexamine its jurisdiction to entertain a counterclaim.
